These Terms & Conditions (“Terms”) govern your use of the Swapizy app, website, and related services operated by Utopia Applications LLC (“Swapizy”, “we”, “us”). By using Swapizy, you agree to these Terms.
What Swapizy does
Swapizy helps users discover possible item-for-item swaps. Users add items, choose one active item, set the category of items they are willing to receive, browse matching nearby items, like or dislike items, and chat only after a mutual match.
Swapizy does not sell items, process payments, set prices, guarantee item condition, guarantee that a swap will happen, or act as a party to any exchange between users.
Eligibility
You must be at least 18 years old, or the age required by local law, to use Swapizy. You must provide accurate account information and keep your account secure. You are responsible for activity that happens through your account.
User responsibilities
You agree to:
- add only items that you have the right to exchange;
- provide honest titles, categories, descriptions, and photos;
- keep one active item selected when using matching features;
- communicate respectfully;
- meet and exchange only when you feel safe;
- comply with applicable laws;
- report unsafe, fraudulent, illegal, or abusive behavior.
You are responsible for deciding whether an item, user, meeting place, and exchange are acceptable to you.
Prohibited items and behavior
You may not use Swapizy to list, request, exchange, promote, or discuss:
- illegal, stolen, counterfeit, unsafe, or regulated items;
- weapons, controlled substances, prescription-only products, hazardous materials, or items that require a license;
- sexually explicit material or services;
- financial products, accounts, documents, identity documents, credentials, personal data, or access to accounts;
- items or conduct that infringe intellectual property rights;
- scams, spam, phishing, harassment, threats, hate, exploitation, or attempts to bypass moderation;
- off-platform activity intended to avoid rules, safety controls, reports, or enforcement.
We may remove content, hide items, restrict chats, ban accounts, or preserve records when needed for safety, enforcement, legal compliance, or abuse prevention.
Matching and chats
A like means that you may be willing to exchange your active item for the liked item. A match occurs only when both users like each other’s relevant items. After a match, a chat may open so users can discuss details.
Chats are for arranging the matched exchange. We may review reports and related chat data when users report safety, moderation, fraud, or rule violations.
Meetings and exchanges
Swapizy does not supervise meetings or exchanges. Use judgment when meeting another user. Consider meeting in a public place, checking the item before exchanging, and stopping the exchange if anything feels wrong.
Each user is solely responsible for the item they provide, the item they accept, and any agreement made with another user.
Account deletion
You may request account deletion in the app or by contacting support. When an account is deleted, active items are removed from discovery, account access is revoked, device tokens are removed, and related chats may be frozen. We may retain limited records for security, fraud prevention, moderation, legal compliance, dispute resolution, or backup recovery as described in the Privacy Policy. Deleted account identifiers may be unavailable for new registration for up to 180 days.
Reports and moderation
You can report items, chats, or accounts. We may review reports manually or automatically. We decide, at our discretion, whether content or accounts violate these Terms. We may take action without prior notice when needed to protect users or the service.
Service availability
Swapizy may change, suspend, or discontinue features. We may perform maintenance, fix bugs, add limits, change matching logic, or update rules. We do not guarantee uninterrupted or error-free service.
Intellectual property
Swapizy, its logo, software, design, and service content are owned by Utopia Applications LLC or its licensors. You may not copy, reverse engineer, sell, or misuse the service.
You keep ownership of content you upload, such as item photos and descriptions. You grant Swapizy a worldwide, non-exclusive, royalty-free license to host, store, display, process, resize, transmit, and use that content as needed to operate, improve, and moderate the service.
Disclaimers
Swapizy is provided “as is” and “as available”. We do not warrant that listed items are accurate, safe, available, authentic, lawful, or fit for a particular purpose. We do not guarantee user identity, item condition, meeting safety, or successful swaps.
Limitation of liability
To the maximum extent permitted by law, Swapizy and Utopia Applications LLC are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, personal arrangements between users, item defects, failed exchanges, or user conduct.
Nothing in these Terms limits rights that cannot be limited under applicable law.
Changes to these Terms
We may update these Terms as the service changes. If changes are material, we will update the date above and may provide additional notice in the app or on the website. Continued use of Swapizy after changes means you accept the updated Terms.
